Widerrufsbelehrung
Sie haben das Recht, binnen dreißig Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist
beträgt dreißig Tage ab dem Tag an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer
ist, die letzte Ware in Besitz genommen haben bzw. hat.
Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (Josef Dostál, U Libeňského pivovaru 2015/10, 18000 Prag,
Tschechische Republik, eshop@fomei.com, Telefon: 420 603 587 227) mittels einer eindeutigen Erklärung
(z. B. ein mit der Post versandter Brief, Telefax oder E-Mail) über Ihren Entschluss, diesen Vertrag zu
widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch
nicht vorgeschrieben ist.
Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts
vor Ablauf der Widerrufsfrist absenden.
Folgen des Widerrufs
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben,
einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie
eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben),
unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über
Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel,
das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich
etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet. Wir
können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis Sie den Nachweis
erbracht haben, dass Sie die Waren zurückgesandt haben, je nachdem, welches der frühere Zeitpunkt ist.
Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem
Sie uns über den Widerruf dieses Vertrags unterrichten, an uns zurückzusenden oder zu übergeben. Die Frist
ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von vierzehn Tagen absenden. Sie tragen die unmittelbaren
Kosten der Rücksendung der Waren. Bei Waren, die aufgrund ihrer Beschaffenheit nicht normal mit der Post
zurückgesandt werden können, betragen diese ab 50 Euro EUR. Sie müssen für einen etwaigen Wertverlust
der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften
und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.

1. Rights from defects
1.1 The customer can claim the rights from defects with FOMEI.

1.2 FOMEI will issue a written confirmation to the Consumer in the event of a personal
claim for a defect (complaint), with the date on which the Consumer exercised the right, what is the content
of the complaint and what method of handling the complaint the Consumer requests; further confirmation
of the date and manner of handling the complaint, including confirmation of the repair and its duration,
or a written justification for rejecting the complaint. Complaints, including the settlement of the defect,
unless a different deadline is agreed with the Consumer, will be settled within 30 days from the date
of the complaint. The expiration of the time limit in vain, if the complaint is justified, is considered
a material breach of contract, for which the Consumer may withdraw.
1.3 In the event of a complaint by e-mail or letter with the specified email address,
a confirmation of the complaint with the requisites specified in the previous paragraph will be sent to
the Consumer by e-mail.
1.4 If the complaint is justified, the Consumer has the right to pay the costs associated
with the application of the defect (complaint), it may be mainly the cost of postage (sending the goods
to the supplier).
2. Warranty
2.1. In addition to liability for defective performance, the supplier provides a guarantee
for quality, ie. is responsible for defects that occur on the goods after receipt during the warranty
period (hereinafter referred to as "warranty").
2.2. The warranty period is 24 months, unless another quality guarantee period has
been agreed or unilaterally provided (for example, by the information on the delivery note, tax document,
etc.) or the warranty is excluded.
2.3. In the event that the goods, its packaging or in the instructions or other
documentation for the goods indicate the service life or durability or usability, which expires before
the warranty period of 24 months, the warranty period always lasts only until the service life or service
life, which is stated on the goods, on its packaging or in the instructions or other documentation for
the goods.
2.4. The quality guarantee begins on the day of receipt of the goods. The warranty covers
material defects, functional defects or defects arising during the transport of goods.
3. Warranty Exclusions
3.1. The warranty does not apply to the sale of used or damaged goods (items), unless
the warranty is expressly agreed or expressly provided unilaterally (for example, by information on the
delivery note, tax document, etc.), including the specific warranty period for these goods.
3.2. The warranty does not apply to defects if, after the transfer of the right, the
risk of damage to the goods was caused to the Customer (ie after taking over the goods) was caused by
an external event. The warranty does not cover delivery defects caused by: fault of the Customer, use
of the delivery contrary to the manufacturer's or Supplier's instructions, further use of damaged or incomplete
or other (including type-identical delivery with other product or serial numbers) delivery, failure to
perform regular routine user control and maintenance according to the manufacturer's instructions (in
any form especially in the enclosed manual), incorrect installation of the Consumer, improper storage,
incorrect use, computer viruses, use of consumables not conforming to the original specification, interventions
in delivery by a person other than the authorized service that the above handling did not cause the defect.
The supplier is not liable for damage caused by a third party, atmospheric discharge in the electrical
network, electrostatic discharge, connection to the electrical network not in accordance with the relevant
ČSN and chemical influences. Furthermore, the warranty does not cover damage caused by a natural disaster,
violent damage, weather or operation under extremely unusual conditions (excessive dust, humidity, etc.)
or in an aggressive environment. The warranty also does not cover any damage to the device due to excessive
mechanical wear.
3.3. Furthermore, the warranty does not apply to goods (things) or their parts (parts)
that are consumable (eg cartridges, toners, printheads, light bulbs, fluorescent lamps, discharge lamps,
batteries), if they have been damaged or reduced in functionality. wear and tear caused by the use of
goods (things).
3.4. The warranty does not cover cases of malfunction of the delivered software
caused by the intervention of the Customer or a third party in the settings of the installed software.
The Supplier is not responsible for the compatibility of the delivery with other devices and software
applications for which the requirement for functionality has not been explicitly replaced by the Customer.
4. Consumables
4.1. If the contents of the package or the subject of delivery or its parts or components
are consumables (eg paper, cartridge, toner, printhead, light bulb, fluorescent lamp, discharge lamp,
battery), its life is indicated on the product, its packaging, instructions, or in the warranty card,
etc.) and if the service life is not stated in this way, the service life is 6 months.
4.2. Neither the liability for defective performance nor the quality guarantee applies
to wear and tear caused by the normal use of the goods (things) and cannot be confused with the service
life or durability or shelf life of the goods (things). The right to claim defects within the statutory
or granted period is not affected, but it is necessary to take into account the above that the right of
defective performance and/or warranty does not apply to wear and tear caused by normal use of the item.
If such goods are used, it is probable that the resulting defect is the result of normal wear and tear,
but it is not excluded that it is in fact a defect in performance or a warranty defect.
5. Software
5.1. In the case of a delivery consisting of the transfer of software licenses, the warranty provided by the Supplier applies exclusively to the physical illegibility of the media and failure of the hardware accessories to the software (HW key, etc.) and does not apply to the functionality of the software. All warranties regarding the functionality of the software arise solely from the warranty terms contained in the software manufacturer's "license agreement." The customer has the right to claim the elimination of the defect for which the warranty is provided, this does not apply to the functionality of the software, which is governed by the "license agreement" of the software manufacturer.
6. Check delivery
6.1. Upon receipt of the delivery, the Customer is obliged to check the delivery
immediately upon receipt of the delivery according to the delivery or transport note or other proof of
delivery. In case of obvious defects, including discrepancies in quantity, measure or weight or damage
to the packaging, the Customer is obliged to apply them immediately, especially to mark them immediately
upon delivery in writing on the receipt and have them confirmed by the person who hands over the goods
(during transport by carrier). The Customer undertakes to immediately inform the Supplier of such defects
and the Supplier undertakes to provide him with the necessary cooperation. If the Customer takes over
the goods that are obviously damaged or incomplete or otherwise obviously defective and confirms the proper
delivery with his signature, it is not possible to file a complaint later. If the Customer confirms the
receipt of the goods without reservations, it is considered that the goods were taken over without obvious
defects.
6.2. If the defect becomes apparent later than when the delivery is handed over,
the Customer is obliged to notify the Supplier of the defects without undue delay after he has been able
to detect the defect with timely inspection and sufficient care.
6.3. The customer must state the exact description of the defect in the warranty
defect notification. If the complaint submitted by the Customer proves to be unfounded, the customer must
reimburse the supplier for all costs associated with the complaint procedure, including transport costs,
etc.
7. For Business
7.1. The rights arising from liability for defects and from the warranty are exercised
by the Customer, who is an Entrepreneur to the contact details according to point 1.1. of these conditions
and in the event of a complaint, the Entrepreneur is obliged to document the acquisition of the goods.
7.2. Complaints between the Customer, who is an Entrepreneur, will be settled by
the Supplier, unless otherwise agreed, in one of the following ways: a) by delivery of the missing part
of the delivery; (b) by granting a discount; c) free removal of defects, d) exchange of delivery. In the
case of a license delivery, the complaint will be settled in one of the following ways: a) by delivering
the missing part of the license delivery; b) by changing the medium.
8. Possibility of resignation and deadline for resignation
8.1. Unless otherwise stated below, the Consumer has the right to withdraw from
the concluded Contract without giving a reason within a period of 14 days, which runs from the day of
concluding the Contract and in the case of:
a) for the purchase contract, from the date of receipt of the goods;
b) a contract having as its object several types of goods or the supply of several
parts, from the date of taking over the last supply of goods;
c) a contract, the subject of which is the regular repeated delivery of goods, from
the date of receipt of the first delivery of goods.
8.2. The consumer cannot withdraw from the contract:
a) on the provision of services, if they have been fulfilled with his prior express
consent before the expiry of the period for withdrawal from the Contract;
b) on the supply of goods or services, the price of which depends on fluctuations in
the financial market independently of the will of the Supplier and which may occur during the period for
withdrawal from the Contract,
c) on the delivery of goods that have been adjusted according to the wishes of the Consumer
or for his person,
d) on the supply of perishable goods as well as goods which have been irretrievably mixed
with other goods after delivery,
e) repair or maintenance carried out at a place designated by the Consumer at his
request; however, this does not apply in the case of subsequent repairs other than those requested or
the supply of spare parts other than those requested,
f) on the delivery of goods in a closed package, which the Consumer has removed from
the package and for hygienic reasons it is not possible to return,
g) on the delivery of an audio or video recording or a computer program (software), if
it has violated their original packaging,
h) on the supply of newspapers, periodicals or magazines,
i) on accommodation, transport, meals or the use of free time, if these services are
provided within a specified period,
j) on the delivery of digital content, if it was not delivered on a tangible medium and
was delivered with the prior express consent of the Consumer before the expiry of the period for withdrawal
from the Contract.
8.3. By agreeing to these terms for the purchase of goods, the Consumer explicitly
requests that the digital content under the Contract, which is not delivered on a tangible medium, be
delivered by the Supplier before the 14-day withdrawal period and agrees to its delivery before the expiry.
By agreeing to these terms for the purchase of goods, the consumer confirms that he understands that
if digital content that is not delivered on a tangible medium is delivered to him before the expiry of
the 14-day period from the conclusion of the Contract, he is not entitled to withdraw from the Contract.
9. Withdrawal procedure
9.1 If the Consumer has the right to withdraw from the Contract as set out in Article
8 above, the Consumer does not need to state the reason for withdrawal and there is no penalty associated
with exercising the right of withdrawal.
9.2 The Consumer may use the sample form to withdraw from the Contract. The Consumer
shall send the completed form by post or email to the contacts listed below. The Supplier does not allow
withdrawal from the Contract using the sample form by filling it in and sending it via the website. The
use of the model form is not an obligation of the Consumer. In the event that the Consumer does not use
the form, he/she must inform FOMEI of his/her withdrawal by unilateral legal action (for example, by letter
sent via the postal service provider to the Supplier's address: FOMEI s. r. o..: Machkova 587, 500 11
Hradec Králové, or by e-mail to obchod@fomei.com).
9.3 If the Consumer exercises the right to withdraw from the Contract as set out above,
the withdrawal period shall be deemed to be maintained if the Consumer sends a notice to the Supplier
during the withdrawal period that he/she is withdrawing from the Contract (withdrawal periods are set
out above).
10. Consequences of withdrawal
10.1. Odstoupí-li Spotřebitel od Smlouvy, zašle nebo předá Dodavateli bez zbytečného
odkladu, nejpozději do čtrnácti dnů od odstoupení od Smlouvy, zboží, které od něho obdržel. Zboží zašle
nebo osobně předá na: adresa FOMEI a.s., Machkova 587, 500 11 Hradec Králové. Lhůta se považuje za zachovanou,
pokud zboží Spotřebitel odešle zpět před uplynutím 14 dnů od odstoupení od Smlouvy.
10.2. V případě odstoupení od Smlouvy nese Spotřebitel náklady spojené s navrácením zboží
Dodavateli.
10.3. V případě odstoupení od Smlouvy dle výše uvedeného Dodavatel vrátí Spotřebiteli
bez zbytečného odkladu, nejpozději do čtrnácti dnů od odstoupení od Smlouvy, všechny peněžní prostředky
včetně nákladů na dodání (kromě dodatečných nákladů vzniklých v důsledku Spotřebitelem zvoleného způsobu
dodání, který je jiný než nejlevnější způsob standardního dodání nabízený společností FOMEI, které od
něho na základě Smlouvy přijal), stejným způsobem – stejným platebním prostředkem, který byl použit pro
provedení transakce, pokud Spotřebitel výslovně neurčil jinak. S vrácením peněžních prostředků Spotřebitel
nenese žádné náklady. Odstoupí-li Spotřebitel od Smlouvy, není společnost FOMEI povinna vrátit přijaté
peněžní prostředky Spotřebiteli dříve, než jí Spotřebitel zboží předá nebo prokáže, že zboží odeslal.
10.4. Spotřebitel odpovídá za snížení hodnoty zboží v důsledku nakládání s tímto zbožím
jiným způsobem, než který je nutný k obeznámení se s povahou a vlastnostmi zboží, včetně jeho funkčnosti.
10.1 If the Consumer withdraws from the Contract, the Consumer shall send or hand over
to the Supplier the goods received from the Supplier without undue delay, but no later than fourteen days
after withdrawal from the Contract. The goods shall be sent or handed over personally to: address FOMEI
s.r.o, Machkova 587, 500 11 Hradec Králové. The time limit is deemed to be maintained if the Consumer
sends the goods back before the expiry of 14 days from the withdrawal from the Contract.
10.2 In case of withdrawal from the Contract, the Consumer shall bear the costs of returning
the goods to the Supplier.
10.3 In the event of withdrawal from the Contract as set out above, the Supplier shall
refund to the Consumer, without undue delay, and no later than 14 days after withdrawal from the Contract,
all monies including delivery costs (except for additional costs incurred as a result of the Consumer's
choice of delivery method other than the cheapest standard delivery method offered by FOMEI and accepted
from the Consumer under the Contract), in the same manner - by the same means of payment used for the
transaction, unless the Consumer has expressly indicated otherwise. The Consumer shall not bear any costs
associated with the return of the funds. If the Consumer withdraws from the Contract, FOMEI shall not
be obliged to return the funds received to the Consumer before the Consumer has handed over the goods
to the Consumer or proved that he/she has shipped the goods.
10.4 The Consumer shall be liable for any diminution in the value of the Goods as a result
of handling the Goods in a manner other than that necessary to familiarise him with the nature and characteristics
of the Goods, including their functionality.
These Warranty and Claims Conditions of FOMEI s.r.o are valid as of 1 June 2014 and are approved by the Director of the FOTO Division.
